Terms of service

EXPECTATIONS & AESTHETIC

The client has spent a satisfactory amount of time reviewing Andi Mejia + Co’s (hereafter, “AM+Co”) work and has a reasonable expectation that AM+Co will perform the Services in a similar manner and style unless otherwise specified in this Agreement.  AM+Co shall have final say regarding the aesthetic judgment and artistic quality of the Services. Dissatisfaction with AM+Co's aesthetic judgment or artistic ability are not valid reasons for termination of this Agreement or refund requests.

PROOFING

It is the client's responsibility to carefully review proofs for any errors-- spelling, locations, dates, addresses, etc. The design of the semi-custom suite is not subject to change or adjustment.  AM+Co agrees to do 1 round of revisions. Additional changes or revisions will result in a $75 charge per revision

Final say for any feedback must come from client directly through the designated form within Dubsado. Changes that are submitted via email, text, phone call, DM, or any other communication funnel other than the designated form for a design round are subject to getting lost and cannot be the responsibility of AM+Co. 

Once approval for the Final Proof is received, client consents to give AM+Co full permission to print all pieces as they appear on the Final Proof. No further changes can be made and AM+Co will not be held responsible for any errors found after client grants approval. AM+Co cannot be held responsible for designs that were approved by client and then printed with an error that CLIENT did not see. Any reprinting costs will be the responsibility of client.

QUANTITIES

Once you have approved your final proof, quantities ordered absolutely may not decrease. It may be possible to increase your order quantity, but it is at the complete discretion of AM+Co. The client should order a minimum of 5-10 extra for keepsakes and for any last-minute guests. On the occasion the client needs extra copies after delivery, AM+Co cannot guarantee a production turnaround on the same timeline as the original order.  

MATERIALS

AM+Co cannot be held responsible for materials that are out of stock, back-ordered, or discontinued, as these situations are out of AM+Co’s control. Should this situation arise, a suitable alternative will be suggested. Additional fees may occur if alternative material is not of equal value. 

INCONSISTENCIES & VARIATIONS

Due to the nature of some of the suites, there will be certain variations along every design.  When ordering a suite with deckled edges, there can be slight changes in the "centeredness" of the print since the paper is not identical in size.   Items with gold leafing may not be identical to the images on the site, as the gold leaf is applied by hand.  

COLORS AND IMAGE QUALITY

All digital screens are calibrated differently, and the colors showcased in digital mockups or proofs may vary slightly when printed. With specialty printing such as letterpress and foil printing, minor variations are to be expected.

Although we strive to represent the colors shown on our website as accurately as possible, we cannot guarantee that the printed color will look exactly the same as the screen color. The actual color you see will depend on your computer system and/or monitor. We cannot guarantee that your computer will accurately display the colors from our collection.

TIMELINE

The general timeline of suite production is as follows:

  • Design process - 3-5 business days
  • Revision process - 3-5 business days per revision (limit 3 total revisions)
  • Production process - 10-15 business days (15-20 days for Lucia suite)
  • Shipping - 5-8 business days (expedited 2-day shipping is available for an additional fee)

Some portions of the process are dependent upon receiving completed forms and approvals from you. AM+Co strives to work within this timeline, but it is important for the client to also cooperate in a timely manner.  Client understands that AM+Co cannot send the final items to client unless timely feedback and approval of sketches and/or a finalized design is received. Client agrees to provide timely feedback within 24 hours of receiving each design round so that AM+Co can understand client’s concerns, objections, or corrections that need to be made to the design(s). Client understands that if feedback is returned to AM+Co longer than 24 hours after receiving a design round, the project might be subject to a delay, which could result in the client’s deadline being missed.  

AM+Co is not responsible for any printing or production delays due to weather, business closings, supply chain issues, holidays, and acts of God.  

RETURNS & CANCELLATIONS

Because of the personalization of semi-custom stationery, orders are non-refundable, without exception. Every effort is made to ensure customer satisfaction. If there is an error on AM+Co's part, AM+Co will do its best to correct the problem.  AM+Co has the right to terminate the contract for any reason, and client will not receive a refund or hold the rights to any design up to the point of cancellation.

SHIPPING

For semi-custom suites, ground economy shipping (5-8 days) is included in the price of your purchase.  Expedited shipping (2-day) is available at the time of order for an additional fee.  UPS is used for any orders shipped and may require a signature at delivery.  Although every possible care will be taken to produce quality design work of all pieces of the project, AM+Co cannot place an unconditional guarantee on the above after it has left for shipment. AM+Co will not be held responsible for any ruined projects due to shipping mishandling or any other cause in or outside of AM+Co’s control. AM+Co will not be held responsible for any late arrivals or ruined projects due to weather or any other cause in or outside of AM+Co's control.

CLIENT agrees and understands that AM+Co cannot be held responsible for any mailed items that are damaged by USPS, as they are an independent third party. AM+Co also cannot be held responsible for any invitations that are marked "return to sender" by the USPS Postal Service. 

DESIGN PROPERTY

AM+Co is solely responsible for printing and producing the work for CLIENT, and will not release any editable files to CLIENT such as Photoshop files, Illustrator files, InDesign Files, Procreate files, etc.

All proofs and design elements are the intellectual property of AM+Co. Proposals, quotes, and proofs may not be shared, copied, or imitated with or by any person. As all designs created by AM+Co are owned by AM+Co. The custom designs cannot be printed by the bride, groom, parents of the couple, or any third party other than AM+Co. This includes crests, stationery artwork, motifs, patterns, illustrations, design elements and calligraphy.

AM+Co owns all copyrights in any and all work(s) created or produced pursuant to federal copyright law (Title 17, Chapter 2, Section 201-02 of the United States Code), whether registered or unregistered. Any and all products, whether tangible or intangible, produced or created in connection with, or in the process of fulfilling this Agreement, are expressly and solely owned by AM+Co and may be used in the reasonable course of AM+Co’s business. CLIENT acknowledges that AM+Co has the right to also use images, design elements, calligraphy, etc. from any portion of the work for portfolio or marketing purposes. 

RESALE

The Service is provided for your use only (unless otherwise specifically stated) and you agree not to, whether for a fee or without charge, reproduce, duplicate, copy, sell, transfer, trade, resell, re-provision, redistribute, or rent the Service, any portion of the Service, use of the Service, or access to the Service, including, but not limited to, reselling capabilities enabled or used by a specific application.

FORCE MAJEURE

No Party shall be liable in damages or have the right to terminate this Agreement for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its control including, but not limited to, acts of God (such as hurricanes, earthquakes, flooding), fire, epidemics, pandemics, Government restrictions (including the denial or cancellation of any export or other necessary license), wars, terrorist acts, insurrections and/or any other cause beyond the reasonable control of the Party whose performance is affected. Should the clients’ wedding be canceled, postponed, or otherwise adversely impacted as a result of a force majeure event, there shall be no refunds for payments already received by designer, but designer will use all reasonable efforts to work with clients to produce the product at a later date if necessary, subject to designer’s availability. Additional fees may be incurred due to designer's and/or Wedding vendors as a result of a rescheduled event, price change, or supply shortage.
